ebay purchase?

I purchased an item on ebay for a Christmas gift. In the large overall description area, it states that the item is New In Box. This is the part that I read when deciding to make a purchase. The item arrived without a box and I complained and the seller said that he put NIB in the main title line of the product description. I want to return this item, as I have no use for a Christmas gift that is not in a box, is this something that the seller has to return OR is it something that I am stuck with. The seller is not willing to return the item, but I feel that he should have revised the overall paragraph description of the item. Please help :- )
Sorry, I guess I should clarify more, he is stating the "NIB" means "Not In Box" and that he sold several of them and some had boxes and some did not (as per the title line) and that I must have accidentally ordered one that did not have a box!

You can check out eBay discussion boards under community at eBay, to get more information on your options. Without seeing the listing it's hard to judge what your options are.

Typically sellers will say right in their auction if they accept returns. They do not have to take the item back, but most people want to avoid negative feedback, and will typically work with someone who is unhappy, of course I think these are people that treat selling on eBay like a business. But if they do not respond negative feedback is an option for you.

You could try and relist the item yourself, and hope you'll get what you paid for it back. Hope that helps.
